Unitalen Won for Liao’s Bon-Bon Chicken on First Instance in Administrative Litigation
November 30, 2006Sichuan Liao’s Food & Entertainment Co., Ltd. (“Sichuan Liao’s”) and Chengdu Liao’s Chain Food, Ltd. (“Chengdu Liao’s”) brought in the court their disputes on the brand “Liao’s Bon-Bon Chicken.” People’s Court of Jintang County in Sichuan Province upheld the Decision on Administrative Penalty made by Jintang AIC. Unitalen won the case on behalf of Chengdu Liao’s Chain Food, Ltd.
On April 7, 2006, Jintang AIC made the Decision on Administrative Penalty against Sichuan Liao’s. According to the decision, Sichuan Liao’s infringed the exclusive right of Chengdu Liao’s because the former used the latter’s registered trademark and conducted false advertisement. Sichuan Liao’s was ordered by the local AIC to stop its infringement conducts and false advertisement, and to pay a fine of 50,000 RMB. Sichuan Liao’s then appealed to the court. At the end of October, the Jintang Court issued a judgment of the first instance upholding the Jintang AIC’s decision.
